Current and former employees can claim back wages and penalties. Up to a settlement share.
Unpaid overtime, off-the-clock work, missed breaks, misclassification — federal and state wage laws don't forgive any of these. Box Overtime Pay has settled. If you worked during the class period, file the claim form and the administrator will calculate what you're owed.
Box settlement payments are individualized and vary by claimant. Your specific payment amount is disclosed in the notice packet mailed to you, and is calculated based on the number of weeks you were employed as an NEE or OBR during the applicable settlement period . OBR weeks are weighted more heavily in the formula than NEE weeks. Half of your payment will be treated as wages and subject to payroll tax withholding, reported on a W-2. The other half will be treated as non-wage income with no withholding but will be reported to the IRS on Form 1099. Checks are mailed after the claims process closes and must be cashed within 120 days of the check issue date.
